Medical cannabis pharmacy information

All medical cannabis products must be purchased from a licensed medical cannabis pharmacy.

There are 15 medical cannabis pharmacy licenses as originally issued by DHHS. Beginning July 1, 2023, medical cannabis pharmacy licenses will be transitioned over to the Utah Department of Agriculture and Food as outlined in 4-41a and will be directly regulated by UDAF. The Utah Medical Cannabis Act requires that each licensed medical cannabis pharmacy have a Pharmacy Medical Provider (PMP) on-site and available to consult with cardholders during business hours. It is the responsibility of the PMP to review medical cannabis transactions and verify that all transactions are completed correctly. Each PMP must register with DHHS. All employees of a medical cannabis pharmacy, with the exception of PMPs, must be registered with UDAF as medical cannabis pharmacy agents and/or courier agents. Medical Cannabis Pharmacy Rule

Agents

A medical cannabis pharmacy agent is any employee of a licensed medical cannabis pharmacy (with the exception of pharmacists and physicians).

A medical cannabis courier agent is any employee of a licensed medical cannabis courier company.

How to become a pharmacy or courier agent

Step 1: Be offered employment at a licensed medical cannabis pharmacy. Employment at a licensed medical cannabis pharmacy is required prior to registering with UDAF as a pharmacy agent or licensed medical cannabis courier. Any fees paid will not be refunded if an applicant applies prior to being hired by a licensed medical cannabis pharmacy.

Step 2: Pay the application fee and get a background check and fingerprints. Applicants must create a UtahID acount, then using the ERS or the EVS, pay the application fee. Once the application fee is paid, download the form for a background check and for fingerprints and take it into a Live Scan Location to get the background check and fingerprints completed and submitted to UDAF.

Step 3: Complete approved continuing education. While waiting for your background check and fingerprints to be sent to UDAF, complete approved continuing education. All pharmacy and courier agents must complete an approved CE course during their initial registration and during each 2-year renewal cycle. Step 4: Finish the online application. In your online application, upload your completion certificate from the CE course in the "Corrected Documentation" tab.

Step 5: Submit the online application. Once UDAF receives your background check and fingerprints, your application will be placed in review.

Step 6: UDAF reviews the pharmacy or courier agent application. UDAF will review the pharmacy or courier agent's application and confirm whether all requirements have been met.

Step 7: Receive the medical cannabis pharmacy or courier agent card. If all requirements have been met, UDAF will issue the card and email the pharmacy or courier agent a copy of their card.

Courier License Information

Pharmacies are able to sell product in their store or through home delivery.

Home delivery is performed by the pharmacy or by a courier company.

The Utah Medical Cannabis Act requires all courier companies to obtain a license with the Utah Department of Agriculture and Food.

Medical cannabis courier companies must:

  • Complete the Medical Cannabis Courier Application
  • Pay an application and license fee
  • Submit an operating plan

      After the above items are approved the courier company will complete the following:

      • Complete background screening for all owners
      • Submit current list of employees
      • Obtain city/municipality business license
